General terms and conditions

General
Unless otherwise agreed in writing, the following conditions apply to all purchases of our goods as well as to the provision of services by Buchmann Direct Electronics AG. These conditions are deemed to be accepted at the latest upon receipt of our order confirmation/invoice or upon acceptance of the goods or services.

Contract conclusion
By placing an order online or by telephone, a contract of sale is concluded between the customer and Buchmann Direct Electronics AG. However, Buchmann Direct Electronics AG can withdraw from the contract within 7 days or until shipment from the product without giving any reason. In case of advance payment, the amount paid will be refunded immediately.

Product range
All product specifications are non-binding. In particular, changes in design and technology, which improve the functionality of a product, as well as errors in description, illustration and pricing are reserved.

prices and terms of payment
All prices are quoted in Swiss francs per piece, pair or set including VAT. The delivery of the goods is without installation or assembly. You will be charged a postage surcharge for delivery. Payment for products is made online against prepayment, credit card, PayPal, TWINT, Postcard and invoice or on collection in our shop against cash, Maestro/Postcard, credit card and Visa/Maestro debit cards. In case of non-collection of a cash on delivery or non-acceptance of an ordered delivery, we will charge you a contribution towards expenses of 5% of the value of the goods, but at least Fr. 50, plus postage or freight charges. Cancellation of ordered products is only possible after consultation with Buchmann Direct Electronics AG.

Delivery conditions
The ordered products can be shipped to a Swiss address. The delivery is carried out by Buchmann Direct Electronics AG, by the post office, cargo domicile or transport company or other third parties. As a rule, the ordered goods are delivered within 3 - 7 working days after conclusion of the contract, provided that the goods are in stock with us or with the general agent. Otherwise, a written confirmation/invoice will be sent with the expected delivery date.

Assembly and installation
We offer an assembly and installation service throughout Switzerland. The installation can either be carried out by our Buchmann installation team (Zurich and surrounding area) or via our installation partner Cool AG against corresponding installation costs. Otherwise, no installation or assembly is included in the price.

Retention of title
If we deliver on Buchmann invoice, with a payment term of 10 days net, the delivered products remain the property of Buchmann Direct Electronics AG until full, actual payment. Buchmann Direct Electronics AG is entitled to make a corresponding entry in the retention of title register. If the customer is in delay with the payment of the purchase price, Buchmann Direct Electronics AG is entitled to withdraw from the contract by means of a declaration of withdrawal and to take possession of the products.

Warranty and liability for defects
In case of defects, the customer is entitled to have the defective unit repaired by the Swiss general agency during the entire warranty period. The customer will inform Buchmann Direct Electronics, then it will be decided whether the defective unit will be sent via BDE or directly to the general agency. The right to cancellation or reduction is excluded. Defective units will not be collected. The customer must send the defective unit to the designated service centre or hand it in at the designated location at his own expense and risk.
We guarantee a professional, quick repair of the unit.
Warranty repairs are only free of charge for the customer if the defect is a product defect or a manufacturing defect and there are no reasons for exclusion. Reasons for exclusion are: Damage due to the elements, moisture damage (oxidation), impact or fall damage, incorrect manipulation and damage due to external influences. In the event of such a reason for exclusion, a cost estimate of CHF 100 (excl. postage and shipping) will be provided. As a matter of principle, we do not assume any guarantee or liability for smartcards (PayTV) of any kind and their functioning. A return of smartcards is also excluded.

The warranty does not cover wear parts such as batteries, rechargeable batteries and housing parts as well as consumables (ink cartridges, toner, diskettes, print heads, etc.); detailed information can be found in the manufacturer's specifications and the warranty certificate. The guarantee also excludes damage caused by additional devices not recommended by the manufacturer which are connected to the product or used together with the product.

Work without warranty
In the event of defects or faulty operation for which there is no guarantee, the purchaser shall bear the costs of troubleshooting. The use of original accessories and original software is a prerequisite for the proper functioning of a device. Liability for incidental extraordinary or consequential damages (in particular loss of use, loss of time, loss of data, inconvenience, loss of business, loss of profit or loss of savings) arising from the use or impossibility of use is excluded.

Cost estimates
The repair service of the Swiss General Agency will automatically prepare a cost estimate as soon as no purchase receipt or warranty document is enclosed with the device. Cost estimates will be issued for non-disassembled or only partially disassembled units. If further defects (e.g. impact, sand, water damage, foreign bodies, etc.) become apparent after the repair has been approved, the repair workshop may interrupt the work and carry out the repair only after a new written order has been issued if the additional expenditure exceeds 10 % of the originally estimated repair value. If the repair is not to be carried out at the customer's request, the item examined need not be restored to its original condition if it is not economically and technically feasible to do so. In order to prepare a cost estimate, it is necessary to intervene in the item. Therefore, if the repair is refused, the unit may not be returned in its original condition. If the customer does not inform Buchmann Direct Electronics AG of a decision regarding the cost estimate within 10 days after receipt of the letter, Buchmann Direct Electronics AG is allowed to return the device and is released from any claims of the customer and the costs incurred will be charged.

Exchange and return
In general, there is no legal right of return in Switzerland. Buchmann Direct Electronics AG grants you a voluntary right of return in accordance with our return conditions.

Returns Possible

A return for credit at the current daily price (maximum the purchase price) is only possible if

the original packaging is present and unopened.
the original label has not been removed.
the item is marked "in stock" and is not an item that has been specially ordered for the customer (e.g. 3-5 days, external stock, ...).
the purchase of the item was made a maximum of 7 days ago.

The actual postage costs incurred will be charged to the customer in the event of a return.


Return after individual examination

A return for credit is possible after individual examination and deduction of a processing fee if

the original packaging is present but has been opened
the item shows no signs of use.
the accessories supplied are complete.

The individual inspection is carried out by Buchmann Direct Electronics AG. A return cannot be guaranteed, even if you have received an RMA number in the returns process. The processing fee after individual inspection is at least 20% of the current daily price (maximum of the purchase price). A decision on the possibility of a return and the specific amount of the lump sum to be deducted from the credit note can only be made after a successful examination.
Please note: The processing fee serves to cover costs in the return process and as we can resell the item at a lower price than it would have cost us to resell it.


No right of return

A return and credit note is not possible if

the original packaging is missing or defective.
Accessories are missing.
Ordered items are items that were ordered for the customer and were not in our own stock. (Availability e.g. 3-5 days, 1-2 weeks, external warehouse, ...)
Consumables are open (ink, toner, water, activated carbon or air filter or similar product).
hygienic reasons do not permit this for products such as headphones, razors, toothbrushes, epilators or similar products
articles are intended for the preparation and/or storage of foodstuffs
it is a child seat
software has been opened (seal broken) / licence(s) have been registered
it is an item that has been registered by the customer.
it is foodstuffs.
the original labels have been removed from clothes.
clothes show signs of use (smell, stains etc.).

Copyright and intellectual property rights
Buchmann Direct Electronics AG reserves all rights, in particular proprietary rights and copyrights, for every design, text and graphics on its websites (homepage). Written permission from Buchmann Direct Electronics AG, Wallisellen, is required before passing on to third parties.

Privacy policy
Buchmann Direct Electronics AG warrants that customer data obtained in connection with an order will only be processed, stored and used for internal purposes and in connection with the processing of the order. For the personal data we assure that all data is observed according to the data protection act and the relevant legal norm.

Jurisdiction and applicable law
These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law. The exclusive place of jurisdiction is Zurich or another legal place of jurisdiction at the discretion of Buchmann Direct Electronics AG.

Purchase on account with instalment facility (POWERPAY)
MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the single invoice, you can simply settle your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order summary in the following month. When the purchase contract is concluded, POWERPAY takes over the invoice claim that has arisen and handles the corresponding payment modalities. When purchasing on account, you accept POWERPAY's terms and conditions in addition to our GTC. (powerpay.ch/en/agb).

concluding provisions
Should individual provisions or several provisions of these GTC be wholly or partially ineffective or later lose their legal effectiveness, this shall not affect the legal effectiveness of the remaining terms and conditions.
